Consent* Terms & Conditions of Entry
The New Zealand Farm Environment Trust (“Trust” or “we”) promotes and manages the Ballance Farm Environment Awards (“Awards Programme”). Entry into the Awards Programme is subject to these terms and conditions of entry (“Terms”).
To enter the Awards Programme, you must complete a Registration Form, either by using this website page or by completing a PDF version, which may be requested from *protected email* .
ELIGIBILITY TO PARTICIPATE
For the purposes of the Awards Programme, we consider entrant business enterprises based on the productive or amenity use of soils, or other natural resources. The entrant’s property must be an economically viable farming or growing enterprise.
To be eligible to enter the Awards Programme, the entrant’s property must be within the boundaries of the area of the Northland, Auckland, Waikato, Bay of Plenty, Hawke’s Bay, Taranaki, Horizons, Greater Wellington, Canterbury, Otago and Southland Regional Councils, or the Gisborne District Council. If your property falls within more than one Regional Council boundary, please nominate which region your entry relates to.
Where the entrant is not the owner of the property and/or business, permission of the owner will be required. Proof of ownership or lease of the property must be provided if requested.
The entrant will be asked to complete a “Getting to Know You” form as part of the Awards Programme process. This will need to be completed and returned via email.
The Trust reserves the right not to consider an entry if it is deemed that it does not support the overall objectives of the Awards Programme. The Trust reserves the right, in its sole discretion, to deny entry to a potential entrant, to deem any entrant ineligible and to terminate an entrant’s entry, if the entrant or their enterprise’s conduct is deemed to bring, or potentially bring, the Awards Programme into disrepute.
You can enter each year into the Awards Programme, unless you are subject to a three-year stand down period. A three-year stand down period applies to anyone who has been a Trustee of the New Zealand Farm Environment Trust, an employee of the Trust or has been a Regional Coordinator, a Judging Coordinator, or a Judge for the Awards Programme in any region.
We will accept only one entry for your property per year.
ELIGIBILITY FOR AWARDS
Awards will be judged by one or more teams of award-related personnel, appointed to act on behalf of the Trust. Winners of awards (Award Winners) will be determined by these teams after one or two rounds of on-site property visits.
Accordingly, the entrant property must have a Health and Safety policy in place and the entrant is expected to inform any Awards Programme visiting personnel on arrival to the property. Confirmation of having an appropriate Health and Safety policy in place is acknowledged by entering the Awards Programme.
While not a condition of participation in the Awards Programme, in order to be eligible for Awards, entrants will need to be compliant with relevant regional council rules and not be under any notice or restriction from the Ministry of Primary Industries (“MPI”). The entrant must advise the Awards Programme of any such notices or restrictions and this, along with any remedial action, will be taken into account within the programme.
The Trust may choose not to allocate a prize in a category should an entrant not meet the award’s criteria. The Trust also reserves the right to cancel an award category in any region should the Trust, in its sole discretion, deem continuing to be unfeasible and no correspondence will be entered into.
Prizes are not transferable. Prizes may be provided in cash or an equivalent value of products/services at the Trust or sponsor’s discretion.
Any decision of the Trust and/or any judging personnel appointed by the Trust on all matters relating to the Awards Programme is final and no further correspondence will be entertained regarding the Awards Programme.
The Trust reserves the right to revoke an Award, if the entrant or their enterprise’s conduct is deemed to bring, or potentially bring, the Awards Programme into disrepute, including where an entrant has already been announced as an Award Winner.
AWARDS PROGRAMME BRAND USAGE
The Trust does not support the promotion of goods, products or services that Awards Programme’ entrants may be associated with and accordingly, all use of Awards Programme branding is restricted by guidelines set by the Trust. Should an entrant become an Award Winner, including the region’s Regional Supreme Winner title, guidelines for Awards Programme Brand Usage will be supplied to the entrant. Such use will generally be allowable for up to two years from the award being given.
PERSONAL INFORMATION, PROMOTION AND PRIVACY
All entrant details will be held by the Trust and may be used for promotional purposes by the Trust or its sponsors without further compensation.
The entrant agrees to participate in the Awards Programme assessment process and assist with publicity of any regional and/or national event as deemed appropriate by the Trust. This may include the production of photographs, stories and/or short videos. Photographs, stories and video are the property of the Trust and will be used to promote the Awards Programme and to promote sustainable farming and growing in general.
Please notify your Regional Coordinator if you do not want this information passed on to the Trust's authorised users including sponsors.
Personal information that the Trust collects from you, whether through your entry into the Awards Programme or otherwise, will be held in accordance with the Privacy Act 2020, the Trust’s Privacy Policy and these Terms. Without limiting the terms of the Trust’s Privacy Policy, you authorise the Trust to use information supplied by you for the purpose of confirming and verifying your entry into the Awards Programme, administering your Awards Programme registration, and facilitating the provision of prizes to you if you are a winner. You have the right to access and correct your personal information by contacting the Trust.
BREACH
The Trust may cancel your entry without notice if it believes that you are in breach of these Terms.
LIABILITY
To the maximum extent permitted by law, the Trust excludes all liability in relation to the Awards Programme including all express and implied warranties and representations. The Trust will not be liable whether in contract, tort (including negligence) or otherwise for any loss, cost or damage however caused (including direct, indirect, consequential or special loss or damage or loss of profits).
AMENDMENT AND VALIDITY
The Trust reserves the right to amend or replace these Terms from time to time.
If any provision of these Terms is held to be invalid, void, unenforceable or illegal for any reason, such provision shall be deemed to be severed from these Terms and the remaining provisions shall continue in full force.
