Spring 2022 Competition

The following terms and conditions apply to all participants in the ‘Ballance Farm Environment Awards Entrants 2023’ New Zealand Farm Environment Trust giveaway social media promotion ("Promotion").

1. Information on prizes and how to participate forms part of these terms and conditions. By participating in this Promotion, you acknowledge and agree to be bound by these terms and conditions.
2. The Promoter is Ballance Agri-Nutrients Limited, 161 Hewletts Road, Mount Maunganui, Tauranga ("Ballance" or the "Promoter").
3. The Promotion is conducted via entry on the New Zealand Farm Environment Trust Facebook account.
4. Entry and participation in the Promotion is dependent on the participant following and acting in accordance with the below terms.
5. The Promotion will commence at 1pm Thursday 29th September and will close at 11.59pm Friday 14th October (“Promotion Period”). Should the Promoter receive low or no entries to the Promotion, the Promoter reserves the right to extend the Promotion closing date.
6. To enter the Promotion, eligible participants must have tagged a farmer or grower and commented why that nominated person or persons would make a great entrant.
7. Every tag and associated comment goes in the draw. The Promoter reserves the right to hide or block comments that are, at the sole discretion of the Promoter, considered automated, spam or are not in line with the community guidelines of the Promoter’s webpage.
8. Entrants acknowledge that the Promotion is in no way sponsored, endorsed, or administered by, or associated with Facebook and any information they provide in connection with the Promotion is provided to the Promoter and not to Facebook. Any questions or comments regarding the Promotion must be directed to the Promoter, not to Facebook. Entrants release Facebook and its associated companies from all liabilities arising in respect of the Promotion.
9. Entry is open to those aged 18 years and over and living in New Zealand. Ballance Agri-Nutrients employees, directors and other representatives of the Promoter and organisations involved in sponsoring or conducting the Promotion (and any individuals so involved) are ineligible, as are members of their immediate families and households.
10. Entry into the Promotion is free. However, any costs associated with accessing the Promotion online are the responsibility of the person seeking access and is dependent on the internet or mobile service provider used.
11. The Promoter accepts no responsibility for lost, late or misdirected entries. The Promoter reserves the right to verify the validity of entries and to disqualify any participant who tampers with the entry process or who submits an entry that is not in accordance with these terms and conditions.
12. The participant is responsible for the submission of their own entry during the Promotion Period and it is not the responsibility of the Promoter or any third party to ensure that a person is entered into the Promotion.
13. The Promoter’s decision is final. No correspondence will be entertained.

Prize Allocation

1. There will be one $2500.00 travel voucher as part of the promotion to one winner. The prize will be drawn in the seven working days after the competition period.
2. The winner will be contacted via Facebook Messenger and the voucher will be emailed to the winner within 7 working days of established contact. If a winner cannot be contacted or does not respond within 48 hours, the Promoter reserves the right to re-select the prize winner. Neither the Promoter, nor its related companies, agents or contractors will be liable for any delay in the delivery of any prize, or the non-delivery of any prize.
3. If the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value.
4. The winner will be chosen at the discretion of the Promoter.
5. No prize is transferable (except as permitted in these terms & conditions) or redeemable for cash.
6. To the maximum extent permitted by law, the Promoter excludes all liability in relation to the Promotion including all express and implied warranties and representations. The Promoter will not be liable whether in contract, tort (including negligence) or otherwise for any loss, cost or damage however caused (including direct, indirect, consequential or special loss or damage or loss of profits).
7. All taxes and any other expenses, costs or fees associated with the prize are the sole responsibility of winners.
8. All participants undertake to comply with the publicity requirements of the Promoter and grant Promoter and its affiliates the irrevocable, perpetual, non-royalty right to feature or publicise on any platform owned/operated by Promoter any materials submitted by the participants.
9. Personal information of participants and those they tag on the facebook post may be collected to enable the Promoter to administer and promote this Promotion and to contact the winner and may also be provided to other third parties assisting the Promoter in this regard, including without limitation, prize suppliers and deliverers, and authorities which regulate this Promotion (if applicable). If a participant does not truthfully provide all the requested personal information, Promoter reserves the right to disqualify or reject his/her entry.
10. Under the Privacy Act 2020, you have the right to access and correct your personal information by contacting Ballance in writing to Ballance Agri-Nutrients Limited Personal Information, Marketing Department, Private Bag 12-503, Tauranga.
11. Promoter reserves the right to amend these terms and conditions at any time and without notice. Participation in this Promotion shall constitute acceptance of these terms and conditions and the amendment thereof.
12. This Promotion and these terms and conditions shall be governed by the laws of New Zealand.
